Litigation Attorney

Brion is a member of the Litigation and Trial Practice Team. He is experienced in commercial, supply chain, land use, and environmental litigation in both state and federal courts. Brion has represented clients in a wide range of commercial and tort cases including class action defense, products liability defense, personal injury defense, commercial contract disputes, covenants not to compete, embezzlement and bank fraud actions, minority shareholder disputes, and collection and creditors’ rights litigation. He has handled all forms of alternative dispute resolution, including facilitative mediation, arbitration and case evaluation under the Michigan Court Rules.

Experience

Currently represents the Michigan Department of Health and Human Services in connection with investigations arising out of the Flint water crisis.

Represented Michigan Sugar Company in multiple class action lawsuits related to alleged nuisance odors from processing facilities, getting all claims dismissed in each case (See, e.g., Detroit Free Press article: Residents lose decision in odor lawsuit against Michigan Sugar (freep.com)).

Regularly litigates and arbitrates global supply chain warranty/recall matters spanning complex discovery and technical issues across North America, and is routinely involved in obtaining or defending against temporary restraining orders and preliminary injunctions for manufacturers (dozens of matters).

Regularly litigates matters for agricultural clients, including contract, regulatory, and employment matters.

Successfully litigated and resolved development dispute for owners of Cadillac Junction, a 500-acre development in Cadillac, Michigan, against efforts by Clam Lake and Haring Townships to block development through the use of an Act 425 Agreement.

Successfully litigated and resolved Township moratorium that was adopted to prevent development of RV-resort on Grand Traverse Bay.

Represented financing company in a series of lawsuits against dealers and administrators of vehicle service contracts brought in the Federal District Court for the Northern District of Illinois and obtained a summary judgment in excess of $10 million and additional settlements exceeding $10 million.

Represented former owner of Dr. Pepper, Snapple and Squirt products in a series of income tax related suits against the United States Department of Justice, as well as related litigation, and in separate cases obtained a jury verdict in excess of $4 million, a bench verdict in excess of $3.5 million, and an $8.5 million settlement. The jury verdict was upheld by the 6th Circuit in a published opinion and was hailed by Forbes as one of the top ten tax cases of the year in 2014.

Armstrong International v Rexnord (arbitration). Represented Armstrong in Chicago arbitration involving UCC contract dispute including Armstrong’s claim for payment of $1.5 million in parts and defense of Rexnord’s contract damage claim for $2 million.

Edward M. Walder, et al v Independent Bank Corporation, et al (Cook County, Illinois, County Department Case No. 05-L-003318); Independent Bank Corporation, et al v Edward M. Walder, et al (State of Michigan, Judicial Circuit Case No. 05-M-24114-CZ). Represented bank in related cases in Illinois and Michigan involving multimillion dollar claims by the bank for indemnification for accounting improprieties against sellers of premium finance company. Defended suit brought by sellers of company alleging millions of dollars in damages for failure to pay earnout and alleged improper application of GAAP. Settlement of both cases resulted in client receiving millions in damages.

Litigation Attorney

Ron is a trial lawyer and former federal prosecutor. He concentrates his practice in civil and white collar litigation, as well as internal investigations. He is a fellow in the American College of Trial Lawyers, a member of the American Board of Trial Advocates, and has been recognized as one of Michigan’s top lawyers by Best Lawyers®Super Lawyers®, Benchmark Litigation© and by Michigan Lawyers Weekly as a Leader in the Law. Ron served as Chair of the firm from 2019 through 2023 and has also served as leader of the Litigation and Trial Practice Team.

Before joining Varnum, Ron served as an Assistant United States Attorney in Miami for the Southern District of Florida, where he prosecuted and tried several large criminal cases. He was also the Deputy Chief of the Major Crimes Division in that office from 2000 – 2001. Since joining Varnum, Ron has tried cases in courts across the country, including New York, Washington, D.C., Florida, North Carolina, Michigan, Tennessee, Kentucky and Kansas. Ron has obtained multimillion dollar verdicts and settlements for plaintiff businesses, including a top ten verdict in Michigan, as recognized by the Michigan Lawyers Weekly. He has also obtained a number of defense verdicts against plaintiffs claiming high damages.

Ron has extensive experience as an instructor of trial advocacy. He has taught at the preeminent trial advocacy program in the United States, the National Institute of Trial Advocacy, and at the National Advocacy Center, which is the trial practice school for the Department of Justice. Since 2006, he has taught at the Hillman Trial Advocacy Clinic, the trial advocacy program for the Western District of Michigan, and he led that program in 2012 and 2013. He is also a federal court approved mediator.

As a former federal prosecutor, Ron represents companies and officers in white collar criminal matters and governmental investigations, and he conducts internal investigations.

Experience

Member of the leadership team assembled by the Independent Monitor named by the U.S. Department of Justice to oversee General Motors’ compliance with its obligations under the Deferred Prosecution Agreement stemming from its recall of defective ignition switches.

Nyal is a member of the firm’s Real Estate Practice Team. Luis focuses his practice on labor and employment issues. Luis has a wide range of experience in traditional labor matters, including grievances, arbitrations, collective bargaining negotiations, union drives, and matters in front of the National Labor Relations Board (NLRB) and the Michigan Employment Relations Commission (MERC). He counsels public and private sector employers on a number of workplace matters, including effective employee handbooks and policies, disciplinary and dispute resolution procedures, discrimination, disability accommodation, wage-hour matters, family medical leave, and harassment and litigation prevention.

Specifically, Seth represents clients on matters related to violations of Michigan’s Natural Resources and Environmental Protection Act (NREPA), including responding to violation notices from Michigan’s Department of Environment, Great Lakes and Energy (EGLE), and negotiating with EGLE on behalf of clients related to enforcement actions and administrative consent agreements. Moreover, Seth has experience in counseling clients through Part 303 (Wetland Protection Act) violations, which often times requires working with environmental consultants to access wetland impacts as well as restoration and mitigation strategies. In addition, Seth has worked on Part 31 NPDES discharge permits, Part 22 Groundwater Quality disputes, and Part 201 Remediation disputes.   

Apart from his NREPA work, Seth also represents renewable energy companies developing wind and solar energy projects. Seth works with his clients to achieve their project goals, including: compliance with local ordinances, attending public meetings to advocate for projects, and counseling clients through every stage of securing a special land use permit. When projects become adversarial Seth works with clients to ensure municipalities follow Michigan’s Zoning Enabling Act, Michigan’s Planning Enabling Act, and Michigan’s Open Meetings Act. Seth has worked on a number of wind and solar projects throughout Michigan. 

Seth will continue working with utility-scale renewable energy developers under Public Act 233’s new state siting scheme, scheduled to take effect in November 2024.

Seth also has experience advising corporate clients on regulatory matters. For example, he advises clients on compliance with California’s Safe Drinking Water and Toxic Enforcement Act, better known as “Proposition 65.” Through that work, Seth assists clients in interpreting guidance and rules issued by California’s Office of Environmental Health and Hazard (OEHHA), and in evaluating their products, product packaging, and supply chains to ensure that their products’ labeling complies with the complexities of Proposition 65.

Seth’s background also includes litigation and representing clients throughout the litigation process.

Seth formerly served as a judicial clerk for Kent County’s 17th Circuit Court. While in law school, he received several legal writing awards and was a member of Michigan State University College of Law’s Trial Practice Institute.

As a former college tennis player, when Seth is not representing clients, he enjoys playing and coaching tennis. While coaching Allegan High School’s Boys Varsity Tennis Team, his team won the MHSAA Division IV State Championship in 2019.
