I-9 Implementation Delayed

February 2, 2009

U.S. Citizenship and Immigration Services (USCIS) delayed implementation of its new Form I-9 until April 3, 2009, scheduled to be effective February 2, 2009. USCIS will accept further comments on the new Form I-9 and may again revise the Form I-9. Many employers have implemented the new Form I-9 in anticipation of the implementation and may have difficulty reverting to the old Form I-9. While employers should attempt to use the correct form, employers should also be particularly careful not to refuse documents removed from the new Form I-9 acceptable list such as expired List B documents.
