A heavy manufacturing/secondary aluminum company was cited by U.S. EPA in a Notice of Violation that it had failed to timely and properly test for MACT compliance. Varnum assisted in developing a strategy of engineering testing and process changes which created a window of opportunity during which time the alleged non-compliance was suspended. EPA agreed to a two-year delay in its enforcement action, and a compromise settlement is currently being negotiated. There was no interruption in production.
