Varnum assisted a dietary supplement wholesaler which was in the process of being investigated by the FDA for potential misbranding claims, including failure to declare an ingredient, and against which the FDA ultimately issued a press release warning the public. We helped the client respond to the investigation, counseled management during the crisis (including interviews with the FDA's Office of Criminal Enforcement), and advised on all manner of business issues, including interfacing with and counseling on interactions with the client's supply chain, distributors, packagers and consumers.
