Michigan and EPA Delay Issuance of Pesticide Discharge Permits

Michigan has announced that due to repeated delays in the issuance of EPA’s long-expected NPDES Pesticide General Permit and because the final language in those permits remains uncertain, the state will likewise delay issuance of its own pesticide permits until EPA takes action.

For the time being, then, applicators of pesticides and herbicides will be regulated by the state under the already-existing regulations under the Rule 97 certification process in the water quality rules or the Part 33, Aquatic Nuisance Control, provisions and will not need a permit under Part 31, the state’s NPDES program.
