Avoid Liability for FDA User Fees
November 15, 2012The FDA requires foreign food facilities, as part of their FDA registration, to appoint a "U.S. Agent" – which is a person or entity that maintains a residence or office, and is physically present, in the United States. Prior to FSMA, there was no liability associated with being named a "U.S. Agent", so many U.S.-based operations of multinational food companies or U.S.-based cooperatives with foreign members agreed to act as "U.S. Agent" for their foreign affiliates. FSMA has now changed that.

FDA Facility Registration Now Open
November 8, 2012After a short delay, FDA has now opened the re-registration process for use by food facilities. The Food Safety Modernization Act requires all food facilities to re-register with the FDA between now and December 31, 2012.
