  • Avoid Liability for FDA User Fees

    The FDA requires foreign food facilities, as part of their FDA registration, to appoint a "U.S. Agent" – which is a person or entity that maintains a residence or office, and is physically present, in the United States.  Prior to FSMA, there was no liability associated with being named a "U.S. Agent", so many U.S.-based operations of multinational food companies or U.S.-based cooperatives with foreign members agreed to act as "U.S. Agent" for their foreign affiliates. FSMA has now changed that.

  • FDA Facility Registration Now Open

    After a short delay, FDA has now opened the re-registration process for use by food facilities.   The Food Safety Modernization Act requires all food facilities to re-register with the FDA between now and December 31, 2012.

    The Food Safety Modernization Act has imposed new registration requirements on the food industry. Last week FDA announced that the registration portal will not be available on time and that FDA would, therefore, not be accepting registration renewals until a later date.
